SNL Biden impersonator Dana Carvey knew former president was 'compromised mentally'

Comedian Dana Carvey, who played former President Biden during the last season of "Saturday Night Live," said last week that he knew the former president was "compromised mentally" while doing his portrayal.

"I knew that he was compromised mentally. I mean, it was obvious to me, but it was a delicate thing in the comedy world. There were a lot of people [who] did not want to do anything that would kind of ding him in like an awkward way," Carvey said during his "Fly on the Wall" podcast last week.

Carvey played Biden on SNL throughout the 2024-2025 season, often mocking the president and his administration, and receiving plaudits for his portrayal of the president as confused and forgetful.

"If I can do Biden, if I can make Biden funny to everybody, then, then I am where I want to be. And then to make it funny, it had to be recognizable. And so there’s certain things I did not include in my package," Carvey told co-host David Spade and guest Julie Bowen, in a clip flagged by Mediaite.

JON STEWART, 'POD SAVE AMERICA' QUESTION BIDEN'S HEALTH IN WAKE OF 'ORIGINAL SIN' BOOK

He repeated a phrase he used while playing Biden and said, "I'm not kidding around here, I'm being serious."

"I think it’s easier to make fun of him if he’s the president. If it’s just a 90-whatever-year-old man, just go look at this a------. So once he’s president then he’s more fair game to say, but no one made fun of him forever," Spade added.

Bowen, known for her role on ABC's "Modern Family," applauded Carvey's Biden impressions as he discussed how he went about portraying the former president.

"And then the defiant, 50s guy. 'There's no crisis at the border,' yeah, but you said, 'Yeah, you got to get your facts right, Jack, I'll beat the hell out of you, you want to do some push-ups, you dog-faced pony soldier," Carvey joked, repeating several famous phrases the former president used.

CHAPPELLE EXPLAINS WHY HE SAID HE'D GIVE TRUMP A CHANCE DURING HIS 2016 'SNL' MONOLOGUE

Carvey said playing Biden was his favorite because he "had like 10 hooks."

The comedian and impressionist also played George H.W. Bush and Ross Perot on "Saturday Night Live," among numerous other roles.

Carvey said during the podcast that one of Biden's staffers came to one of the shows and said he loved the impressions.

Florida man indicted for '86' posts allegedly threatening to kill Alina Habba

FIRST ON FOX: A Florida man was indicted Friday for allegedly threatening to kill Alina Habba in a series of online "86" posts against the interim U.S. attorney for New Jersey, Fox News Digital has learned.

The "86"" has been interpreted by law enforcement officials to mean "get rid of."

Gregory W. Kehoe, the interim U.S. attorney for the Middle District of Florida, announced the charges Friday.

According to the indictment reviewed by Fox News Digital, Salvatore Russotto made a threat in May to "injure and kill the victim in a series of online posts."

FBI DIRECTOR PATEL SAYS HE'S HAD TO DIVERT RESOURCES TO INVESTIGATE 'COPYCATS' OF COMEY '86 47' POST

Fox News Digital has learned that the victim referred to in the indictment is Habba, the interim U.S. attorney for New Jersey who previously served as counselor to President Donald Trump.

"[VICTIM] is a c---," Russotto posted. "86 that b----."

He also allegedly posted: "A slow painful death for [VICTIM]. 86 that c---."

Russotto also allegedly posted: "Eliminate [VICTIM]. 86 Traitor. Death penalty for all traitors."

Russotto was charged with transmission of an interstate threat to injure and retaliating against a federal law enforcement officer by threat.

"This is yet another disturbing example of a dangerous copycat inspired by the reckless behavior of former officials, targeting those who serve our country and threatening the very people working to keep America safe," FBI Director Kash Patel told Fox News Digital. "Our FBI will not tolerate political violence in any form.

"I’m grateful to our law enforcement partners in Florida for their swift action and steadfast commitment to justice."

The indictment comes after Patel said he has been forced to divert agents to investigate "copycats" of potential threats to Trump as a result of former FBI Director James Comey’s "86 47" social media post last month.

FORMER FBI DIRECTOR JAMES COMEY MEETS WITH SECRET SERVICE AFTER CONTROVERSIAL '86 47' POST

"Do you know how many agents I’ve had to take offline from chasing down child sex predators, fentanyl traffickers, terrorists, because, everywhere across this country, people are popping up on social media and think that a threat to the life of the president of the United States is a joke and they can do it because he did it?" Patel said last month.

"That’s what I’m having to deal with every single day, and that’s what I’m having to pull my agents and analysts off because he thought it was funny to go out there and make a political statement."

An FBI official told Fox News Digital the agency cannot disclose the number of "copycat" incidents due to ongoing investigations but described the number to Fox News Digital as "significant."

Comey met with Secret Service officials in Washington this month for an interview about his "86 47" Instagram post, two sources briefed on the meeting told Fox News.

Comey is under investigation for the now-deleted Instagram post that showed seashells arranged on a beach to say "86 47."

"Cool shell formation on my beach walk," he wrote along with the post.

Comey offered an explanation for the post after he received backlash on social media.

"I posted earlier a picture of some shells I saw today on a beach walk, which I assumed were a political message," the subsequent post from Comey said. "I didn't realize some folks associate those numbers with violence. It never occurred to me but I oppose violence of any kind so I took the post down."

The president, in a May interview with Fox News' Bret Baier, didn't accept Comey's explanation.

"He knew exactly what that meant. A child knows what that meant," Trump told Baier. "If you're the FBI director, and you don't know what that meant, that meant ‘assassination,’ and it says it loud and clear."

Congressman calls on Noem, Dr. Oz with plan to 'swiftly remove' 1.4 million illegal migrants on Medicaid

Wesley Hunt, R-Texas, sent letters to two key agency heads with a plan to "swiftly" remove roughly 1.4 million illegal immigrants currently receiving Medicaid in the US.

"While Democrats in Congress continue to peddle falsehoods and fear-mongering over so-called ‘Medicaid cuts,’ they conveniently ignore a staggering truth: over 1.4 million illegal aliens are receiving Medicaid benefits, an unsustainable burden on the American taxpayer," Hunt told Fox News Digital.

Department of Homeland Security (DHS) Secretary Kristi Noem and Centers for Medicare and Medicaid Services (CMS) Administrator Dr. Mehmet Oz were both recipients of Rep. Hunt’s letter this week, which proposed a task force to "identify" and remove the illegal migrants on Medicaid.

TRUMP DHS SUES ENTIRE BENCH OF FEDERAL JUDGES IN MARYLAND DISTRICT COURT OVER AUTOMATIC INJUNCTIONS

"I’ve formally requested the Secretary of Homeland Security to establish a task force to identify those unlawfully exploiting our healthcare system and ensure they are swiftly removed from our country," Hunt added.

The Texas Congressman’s comments come as President Donald Trump’s "One Big Beautiful Bill," which includes a provision stripping illegal migrants from taxpayer-funded healthcare, faces last-minute changes in the Senate.

Fox News Digital obtained a document from the Congressional Budget Office sent to two GOP committee chairmen this week with information regarding the "One Big Beautiful Bill" that reads:

WHITE HOUSE SAYS CONGRESS DEBATING ‘FOOTNOTES’ ON ‘BIG BEAUTIFUL BILL,’ NOT EXPECTING MAJOR CHANGES

"About 1.4 million would be people who do not meet citizenship and immigration status requirements for Medicaid enrollment but who would be covered under current law in programs funded by the states."

On Thursday, the Senate Parliamentarian moved to strike out current language in the legislation that would exclude illegal immigrants from Medicaid eligibility, but sources close to negotiations tell Fox News Digital that those portions of the bill are actively being re-drafted in an attempt to ensure they are included in the final draft of the bill.

Senate Majority Leader John Thune, R-South Dakota, also addressed the parliamentarian's decision to remove the portions about Medicaid to reporters Thursday morning.

TRUMP PRESSURES CONGRESS TO PASS 'BIG, BEAUTIFUL BILL,' INSISTING 'NO ONE GOES ON VACATION UNTIL IT’S DONE'

"These are speed bumps along the way. We anticipated those and so we have contingency plans," Thune explained. "Obviously, you have to adjust the timing and schedule a little bit, but we're moving forward."

Regardless of whether Medicaid is removed from the "One Big Beautiful Bill," Congressman Hunt says that being able to identify the free healthcare-receiving illegal migrants alone is enough reason to remove them from the US.

"Through coordinated efforts between DHS and CMS, we can develop an effective approach to identify people based on financial data, residence, or medical records, and then take appropriate action against those violating our immigration laws," Hunt’s letter to Noem and Dr. Oz reads.

Trump pressures Congress to pass 'BIG, BEAUTIFUL BILL,' insisting 'NO ONE GOES ON VACATION UNTIL IT’S DONE'

President Donald Trump pressured Congress to pass the "BIG, BEAUTIFUL BILL" as soon as possible on Tuesday, while also continuing to lob broadsides against Rep. Thomas Massie, R-Ky.

"Now that we have made PEACE abroad, we must finish the job here at home by passing "THE GREAT, BIG, BEAUTIFUL BILL," and getting the Bill to my desk, ASAP," the president declared in a Truth Social post.

"To my friends in the Senate, lock yourself in a room if you must, don’t go home, and GET THE DEAL DONE THIS WEEK. Work with the House so they can pick it up, and pass it, IMMEDIATELY. NO ONE GOES ON VACATION UNTIL IT’S DONE. Everyone, most importantly the American People, will be much better off thanks to our work together. MAKE AMERICA GREAT AGAIN!" the president declared.

Trump, who targeted Massie in Truth Social posts on Sunday and Monday, continued lambasting the congressman on Tuesday, claiming that the lawmaker is "very bad for the Constitution," and "votes, ‘NO!’ on everything, because he thinks it makes him cool, but he's not cool, he's a LOSER!"

THOMAS MASSIE SAYS HE FEELS ‘MISLED’ BY TRUMP AFTER IRAN STRIKES: ‘HE’S ENGAGED IN WAR'

Massie replied to Fox News Digital's comment request on Tuesday by sharing the 2022 endorsement message in which Trump called him "a first-rate Defender of the Constitution" and "a Conservative Warrior for Kentucky's 4th Congressional District!"

The congressman also shared a screenshot of the statement on X and wrote, "For those who want to know what @realDonaldTrump really thinks of me, this should clear things up…"

Last month Massie was one of the two House Republicans who voted against passing the One Big Beautiful Bill Act when it cleared the chamber.

REPORTER'S NOTEBOOK: WHO REALLY DECIDES WHEN AMERICA GOES TO WAR? THE ANSWER ISN'T SO CLEAR

The congressman declared on Saturday in a post on X that the president's strikes against Iran were "not Constitutional."

Trump unloaded on Massie in a Truth Social post on Sunday, indicating that he will campaign against the lawmaker.

"MAGA should drop this pathetic LOSER, Tom Massie, like the plague! The good news is that we will have a wonderful American Patriot running against him in the Republican Primary, and I’ll be out in Kentucky campaigning really hard," Trump declared amid the anti-Massie diatribe.

Navy using munitions at 'alarming’ speed to defend Israel

The U.S. Navy used its munitions at an "alarming rate" to defend Israel from recent Iranian strikes, a military official said Tuesday, raising questions from lawmakers about how it intends to replace and maintain stockpiles amid global threats.

Admiral James Kilby, Naval Operations acting chief, made the remark in his testimony during a Senate Appropriations Committee hearing on the Navy’s budget in Washington when Sen. Brian Schatz, D-Hawaii, asked about the Navy’s available munitions to defend against global threats.

"The latest round of conflict in the Middle East utilized large amounts of munitions to defend Israel from Iranian strikes," Schatz said. "Does the Navy currently have all the SM-3s it needs for global threats?"

"We do, sir," Kilby responded, "but we are, to your point, using them at an alarming rate. As you know, those are missiles procured by the Missile Defense Agency and then delivered to the Navy for our use. And we are using them quite effectively in the defense of Israel."

An SM-3, or Standard Missile 3, are missiles that the Navy uses as a defense to intercept and destroy short- and medium-range ballistic missiles.

"We need more munitions, air defense interceptors, long-range fires, artillery," Sen. Mitch McConnell, R-Ky., said during the hearing. "Recent conflict tells us we need a lot more of them."

McConnell asked how the Navy and Marine Corps were addressing the challenge of these munitions not being produced fast enough.

John Phelan, secretary of the Navy, said this was a main concern that officials were focusing on to "get fixed."

"We are looking at a number of different avenues, including other parties and different ways of making some of these munitions," Phelan said. "This is a huge priority from both the secretary of defense and the president, and we are putting as much effort and time into this as we are in shipbuilding."

More Iranians with criminal histories arrested by ICE in Trump's security sweep: 'Worst of the worst'

EXCLUSIVE: At least five more Iranian nationals were arrested on Monday in addition to the 11 announced by the Department of Homeland Security on Tuesday morning.

On Monday, 45-year-old Mohammad Hassanpoor was arrested by officers in Baltimore and given a "Third County Notice." He was previously criminally convicted of "assault with a deadly weapon or force likely to produce great bodily injury," where he was sentenced to just under a year behind bars.

He was also previously sentenced roughly three months behind bars for "battery: spouse/ex sp/date/etc." and sentenced to two years for stalking.

Kaveh Abedi, 45, was arrested in Chicago on Monday for "violations of the Immigration and Nationality Act" and had a 2001 conviction for selling cocaine.

Arish Rustami was also arrested and has a prior sex offense, and Abdolmohammad Raghibzadeh was taken into ICE custody on Monday. He’s had a deportation order since November 2005 from an Arizona immigration judge, and he’s currently an Iranian citizen, according to ICE.

In 1999, he previously faced arrests for "domestic violence, vandalism and intimidation" and faced 90 days behind bars and five years of probation as a result. He faced two other arrests and jail time for "violations of probation of the previous crimes."

In May 2006, Raghibzadeh could not get proper paperwork to go back to Iran, so he was given an "order of supervision" and then released.  But in 2007, he was arrested again by sheriffs in Santa Ana, Calif., for not following probation and had to spend the rest of it at the California Chino Detention Center, according to ICE.

Sahand Yousefinasrabadi was arrested Monday by federal authorities "during targeted enforcement action" in Forth Worth, Texas. Yousefinasrabadi was convicted in Sept. 2013 of aggravated sexual assault of a child, and he was asked in October 2013 to leave the U.S. by an immigration judge.

EX-ICE CHIEF WARNS BIDEN'S BORDER CRISIS LIKELY FUELED IRANIAN SLEEPER THREAT IN US

The arrests come amid concerns about Iranian sleeper cells in the United States following the strikes on nuclear sites in the Middle Eastern nation. While there is currently a ceasefire between Iran and Israel, DHS noted the arrests made since Sunday.

"Under Secretary Noem, DHS has been full throttle on identifying and arresting known or suspected terrorists and violent extremists that illegally entered this country, came in through Biden’s fraudulent parole programs or otherwise," DHS Assistant Secretary Tricia McLaughlin said in a statement about the initial 11 arrests that were publicly announced.

"We have been saying we are getting the worst of the worst out—and we are. We don’t wait until a military operation to execute; we proactively deliver on President Trump’s mandate to secure the homeland," McLaughlin added.

Notably, Yousef Mehridehno was arrested by ICE on Sunday in Mississippi and was on a "known or suspected" terror watchlist as of February.

Former Islamic Revolutionary Guard Corps member Mehran Makari Saheli was arrested by ICE in Minnesota, and DHS said he has "admitted connections to Hezbollah" and stayed in the U.S. despite being court-ordered to leave in June 2022.

During the Biden administration alone, 729 out of the roughly 1,500 Iranian nationals that came into the country illegally were released into the U.S.

Tom Homan warns Iranian 'sleeper cells' could be hiding in US as result of Biden's border crisis

Biden-era open border policies have ignited concerns that Iranian "sleeper cells" could be lying in wait inside the U.S., eager to retaliate after tensions with the U.S. adversary reached a boiling point over the weekend, and the prospect has officials on high alert.

Border czar Tom Homan called it the "biggest national security vulnerability" the U.S. has ever seen.

"It's a significant threat," he said Tuesday on FOX Business' "Mornings with Maria."

HOSPITALS IN SANCTUARY CITIES COULD BE MOST VULNERABLE TO IRAN TERROR ATTACKS, WARNS EXPERT

"The average under the Biden administration every single day was 1,800 known gotaways… these are people we knew came to the United States and entered illegally. We don't know who they are, where they came from, why they're here, but they got away."

Homan stressed that the sleeper cell prospect has been one of his top concerns for years. Now, the Trump administration is focused on "clean[ing] up" the mess left by the previous administration, an effort that started with securing the border.

"We knew we had a big job to do, and we're working on it," he said.

Former acting DHS secretary Chad Wolf echoed Homan in citing the countless number of unidentified foreign nationals who poured across the U.S. border under former President Biden's tenure.

EX-ICE CHIEF WARNS BIDEN'S BORDER CRISIS LIKELY FUELED IRANIAN SLEEPER THREAT IN US

"This is a real concern, and, unfortunately, four years of the Biden administration will eventually have consequences," Wolf said during an appearance on "America's Newsroom" on Tuesday.

Speaking to guest host Bill Melugin, he warned that "Hezbollah and Hamas and others" are already in the United States.

"We'll see if they are activated. We'll see if they're inspired. The FBI and local law enforcement – I know they're doing everything that they can…" he added.

A senior U.S. Customs and Border Protection (CBP) source recently revealed that over 1,500 Iranian nationals who illegally entered the U.S. at the southern border were arrested under the Biden administration, and nearly 50% of them were released back into the country.

Hours after President Trump addressed the nation about successful military strikes against key Iranian nuclear sites over the weekend, the DHS issued a memo sounding the alarm on a "heightened threat environment" in the U.S.

The bulletin came as Iranian officials warned of retaliation against the U.S., but did not cite any specific threats.

Senator Alex Padilla slams JD Vance after VP called him 'Jose' during a press conference

Sen. Alex Padilla, D-Calif., responded to Vice President JD Vance calling him "Jose" during a press conference in Los Angeles on Friday, which led to major backlash from Democrats across the country.

The Democratic senator was forcibly removed and detained during a press event in his home state involving Homeland Security Secretary Kristi Noem on June 12. His Republican colleagues blasted the senator for potentially breaking the law and making "a spectacle of himself" rather than doing his job.

Padilla argued on MSNBC on Saturday that Vance's decision to call him "Jose" exemplifies how "petty and unserious" the Trump administration really is.

DEMOCRAT SENATOR FORCIBLY REMOVED AFTER CRASHING DHS SECRETARY NOEM'S PRESS CONFERENCE

"He knows my name," Padilla asserted, adding, "He's the Vice President of the United States — you'd think he'd take the situation in Los Angeles more seriously."

Senator Padilla criticized the vice president for not meeting with the families in Los Angeles who have been "terrorized" by the administration's deportation efforts "to feel what's really going on, on the ground."

He then went on to allege that many of the Marines that were sent to Los Angeles to contain the anti-ICE protests are not happy about being there.

"You saw him [JD Vance] shaking hands with Marines — but did he listen to the Marines?" Padilla questioned. "Because we have report after report of the Marines — so many of the Marines themselves that don't want to be there. That's not why they enlisted."

Continuing his criticisms of Vance, he slammed the vice president for not speaking with the "concerned" employers of illegal immigrants who he claims have been speaking out against the administration's deportations.

"How about this — just take a moment and talk to the Sheriff of Los Angeles County," he railed. "Talk to the Chief of Police of Los Angeles City and hear from them their frustration for the lack of communication, the lack of coordination — this unnecessary and counterproductive build-up."

Rays' Hunter Bigge carted off field in 'terrifying' scene after being struck in the face by 105-mph ball

Tampa Bay Rays pitcher Hunter Bigge was carted off the field at George M. Steinbrenner Field in a terrifying scene after the reliever was struck in the face by a foul ball in Thursday night’s game against the Baltimore Orioles.

Bigge was struck by a 105-mph ball off the bat of Orioles catcher Adley Rutschman at the top of the seventh inning. The ball, heading straight for the dugout, struck Bigge on the right side of his face.

"Certainly you feel for Hunter and his wife. I can't imagine what she and he were going through," Rays manager Kevin Cash said, via MLB.com. "Scary for everybody, none more than them."

Bigge was placed on a backboard after receiving medical attention in the dugout. Despite a bloodied face, Bigge gave a thumbs-up to fans who looked on in fear. He was taken to a hospital for further evaluation, but Cash said Bigge never lost consciousness and was able to speak with first responders.

The game was delayed by eight minutes, but the scary scene left fans and players in a state of shock.

"It’s really scary, it’s terrifying. We sit in these dugouts every night, and, in a lot of ways, you kind of feel like a sitting duck," Orioles interim manager Tony Mansolino said after the game. "It’s just terrifying."

PIRATES RELIEVER DENNIS SANTANA SWINGS AT FAN WHO 'CROSSED THE LINE' DURING FIERY ALTERCATION

Rutschman echoed that sentiment, adding that he’s "praying" for the best.

"I saw it [come] off my bat, and it was just really, really scary. I’m praying for him and for his recovery, hope he’s doing OK. I’m just – it’s scary," he told reporters in the locker room. "You never want to see that. I think everyone wishes for the best health for everyone in this game, and you hate to see that. I hope he’s doing OK."

Bigge is on the 15-day injured list with a lat strain. He has a 2.40 ERA in 13 relief outings covering 15 innings this season.

Virginia Republican who could become state's first woman governor shrugs off identity questions

Virginia Lt. Gov. Winsome Earle-Sears says she is not focusing on the potential historic chance of becoming her state’s first female governor and is instead concentrating on her policies and message.

"People are looking, I think, past the fact of my skin color, even my gender. It means that they want to hear a message," Earle-Sears told CNN in an article published Tuesday.

"So, I’m not really focused on the historic aspect," the presumptive Republican nominee added. "It’s wonderful. It’s good. But what are your policies? How will your policies help my family?"

TRUMP NOT ON BALLOT BUT PRESIDENT INFLUENCES TUESDAY'S HIGH-STAKES PRIMARY

Earle-Sears, who is running unopposed in the GOP primary for governor to succeed term-limited Gov. Glenn Youngkin, said in a May 28 X post that she stands out from other candidates because she is not a "typical" politician.

Her Democratic opponent, former Rep. Abigail Spanberger, is also running unopposed in her primary, meaning Virginia will elect a woman governor this fall, no matter what.

Spanberger has said that she is excited about the prospect of becoming Virginia’s first female governor, telling CNN in the same piece that, "What I hear from voters is we would be so excited to have you be our first woman governor." However, the article noted she's not playing up her gender on the campaign trail.

"Certainly, when I’m out campaigning and spending time across Virginia, I know it is on the mind of some Virginians," but she said if she did win, "My focus is going to be on delivering on the promises and work that I set out to do when I began my campaign."

Kelly Dittmar, director of research for the Center for American Women in Politics at Rutgers University, told CNN that she thinks gender is not the only factor at play for voters when they choose a candidate.

"The women themselves are very unlikely to use their gender solely as they’re making history as part of their campaign strategy, because it’s not something we’ve seen move voters in significant ways when it comes to who they’re going to vote for or even voter turnout," said Dittmar.

History suggests Spanberger is the favorite in the state that's gone blue in recent presidential elections, although Earle-Sears' allies say not to count her out and point out Youngkin was an underdog in 2021.

In 11 of the past 12 Virginia gubernatorial elections, the winner has been in the opposite party of the previous year's presidential election winner. In 2021, Youngkin won in an upset over Democrat Terry McAuliffe after Joe Biden was elected president in 2020. In 2017, Democrat Ralph Northam was elected a year after Donald Trump first won the White House.

Monahan will shift his day-to-day responsibilities to Rolapp and focus more on his position on the PGA Tour board, along with the commercial PGA Tour Enterprises board, through 2026.

"Over the past few years, the TOUR has made meaningful progress in addressing these changes - from creating more opportunities for players to improving the competitive structure and enhancing the fan experience. But there's still significant work to do and incredible opportunity remains ahead. From creating the highest quality golf product that includes the best players in the world, to strengthening commercial partnerships - as I spoke to players, board member, and fans in recent months, I felt drawn to this potential," Rolapp said.

Monahan's announcement comes amid continued negotiations with the Public Investment Fund and LIV Golf, which were unearthed over two years ago. No agreement has ever materialized as Monahan has continued to get criticism.

Javier Bardem tells ‘The View’ he believes Israel is committing 'genocide' in Gaza

Spanish actor Javier Bardem used his platform on "The View" on Monday to condemn Israel’s actions in Gaza as "genocide."

During a conversation about the importance of activism with the show's co-hosts, the "Skyfall" and "Dune" star mentioned the suffering he and others have experienced while watching Israel’s war against Hamas, stating that he has seen videos of Palestinian children "being murdered" by Israel.

"But the situation in Gaza has come to a term now where I cannot — I cannot express the pain that I, along with many millions of people there, suffer on a daily basis watching those horrible images of children being murdered and starving to death."

MAJORITY OF AMERICANS BACK ISRAELI AIRSTRIKES ON IRAN, POLL SHOWS

Bardem said "of course" Hamas has "to return those hostages obviously," but shifted to his focus, which was his condemnation of Israel’s actions in Gaza.

The actor claimed that children in Gaza are being "absolutely blocked" from getting "the aid of medicine, water, medical material" by Israeli forces.

CBS News reported how the Hamas-run Gaza Health Ministry said on Monday that "33 Palestinians were killed trying to reach the GHF [Gaza Humanitarian Foundation] center near the southern city of Rafah on Monday while another was fatally shot trying to reach a GHF hub in central Gaza. It said four other people were killed elsewhere in the war-torn enclave."

ABC NEWS INSIDER SAYS THERE WAS 'NO ALTERNATIVE' BUT FOR NETWORK TO FIRE TERRY MORAN OVER ANTI-TRUMP POST

Israeli military forces did not give comment to CBS News about their report, though the outlet noted that they said previously that they have fired warning shots at suspect individuals approaching their positions while Palestinians gathered to receive aid.

Bardem continued, saying he agrees with the organizations that have called Israel’s actions in Gaza a "genocide."

"I mean, experts on international law, Amnesty International, international human rights and some people that know what they’re talking — and Holocaust survivors — are calling a genocide for it. If you ask me, I believe it’s a genocide," he said.

He gave reasons, stating, "Why is that? First of all, because the impunity that is taking Israel in doing these actions and the lack of, of action on any government. Yes, of course, the backup of United States with all those weapons and the economics and also the silence of Europe is creating a scenario where there’s such an impunity that if we really don’t do something about that, we are going towards well, what is happening now – an absolute impunity on creating wars all over and creating so much pain that is going to affect so many people."

As the music indicating a commercial break started playing, Bardem got one last statement in, saying, "But also – with this I will finish, the most important thing is to not lose the humanity and really denounce when we have to denounce and who we have to denounce."

EU chief agrees with Trump on China trade issues, declares ‘Donald is right’

European Commission President Ursula von der Leyen found some mutual understanding with President Donald Trump during the G7 conference, declaring "Donald is right" about China's certain trade policies.

"When we focus our attention on tariffs between partners, it diverts our energy from the real challenge — one that threatens us all," von der Leyen said during a meeting at the G7, which included Trump's attendance before his abrupt departure back to Washington, D.C., on Monday, Politico reported.

"On this point, Donald is right — there is a serious problem," she added, referring to China ignoring global trade rules.

Von der Leyen was referring to China's restrictions on raw material exports needed for cars, batteries and wind turbines, with the European Commission chief accusing China of "weaponizing" its ability to produce critical raw materials while icing out competitors.

Specifically, China restricted its exports of permanent magnets globally back in April, when Trump rolled out his reciprocal tariff plan that aimed to bring parity to the U.S.' chronic trade deficit.

G7 SUMMIT OPENS IN CANADA, WITH LEADERS TO ADDRESS TRADE, WARS WHILE HOPING TO AVOID CLASH WITH TRUMP

China has focused on "undercutting intellectual property protections, massive subsidies with the aim to dominate global manufacturing and supply chains. This is not market competition — it is distortion with intent," von der Leyen said, while also warning against "a new China shock" as the country floods the global market with inexpensive subsidized products, Politico reported.

GERMANY'S MERZ TO 'ADAPT' TO TRUMP DURING HIGH-STAKES MEETING ON TARIFFS, DEFENSE

Von der Leyen has previously traded barbs with Trump, including over trade in April, when she warned "global markets are shaken by the unpredictable tariff policy of the U.S. administration."

Ahead of the June summit in Canada, the EU leader reported on X that she had an overarching and "good call" with Trump.

"Good call with President Trump ahead of the G7 Summit," she posted on X Saturday. "We discussed the tense geopolitical situation in the Middle East as well as the need for close coordination on the impact on energy markets. We also discussed the situation in Ukraine, the imperative for a ceasefire and the need to keep up pressure on Russia. Finally, we took stock of the ongoing trade talks. I reiterated our commitment to reach a good deal before July 9."

The EU leader's remarks were made before Trump abruptly departed the summit Monday, following a day of meetings. The G7 summit, Trump's first under his second administration, kicked off Monday morning and will run through Tuesday in a remote ski town in Alberta, Canada.

Upon his trip back to the capital, Trump told the media that the EU had not offered a fair trade deal, adding that, "They’re either going to make a good deal, or they’ll just pay whatever we say they have to pay."

Trump has previously threatened imposing tariffs up to 50% on all EU imports if a trade deal is not reached by July.

The summit was expected to focus on trade, the ongoing war between Russia and Ukraine, and tensions in the Middle East. However, emphasized focus was placed specifically on Israel and Iran after Israel launched preemptive strikes on Iran Thursday evening after months of attempted and stalled nuclear negotiations and subsequent heightened concern that Iran was advancing its nuclear program.

The two nations have continued trading deadly strikes since, with Trump abruptly ending his trip to Canada and heading back to Washington, D.C., while warning on Truth Social, "IRAN CAN NOT HAVE A NUCLEAR WEAPON. I said it over and over again! Everyone should immediately evacuate Tehran!"

TRUMP, RUBIO CUTTING G7 TRIP SHORT, RETURNING TO DC AS CHATTER INDICATES IRANIANS FLEEING TEHRAN

When asked why Trump abruptly left the G7, he told the media on Tuesday, "I don’t believe in telephones," adding that "being on the scene is much better."

"And we did everything I had to do at the G7. We had a good G7," Trump added.

Trump is expected to report to the Situation Room at the White House as tensions flare between Israel and Iran.

Fox News Digital reached out to the European Commission for any additional comment on von der Leyen's remarks Monday but did not immediately receive a reply.

2 NYC court officers stabbed at site of iconic trials

Two New York City court officers were slashed in what authorities are calling a "targeted attack."

It happened in the criminal court building in Lower Manhattan on Monday morning, state Office of Court Administration spokesman Al Baker told Fox News.

"Preliminary information indicated that at least two Court Officers suffered stab and slash injuries in the attacks that broke out shortly before 9:45 am in the lobby on the south side of the building," Baker said in a statement.

"Several Court Officers immediately rushed to stop the assailant, subduing him near a bank of magnetometers, disarming him, and taking him into custody," he continued.

The assaults on the officers were caught on camera and "appeared preliminarily to be a targeted attack of the uniformed officers working security details at the courthouse," Baker said.

The stabbings took place beyond the court's metal detectors. It is not known how the weapon made it into the court lobby.

One of the officers walked himself to an ambulance and another was taken to a separate ambulance in a wheelchair.

Although they are both in stable condition and are expected to recover, the New York State Supreme Court Officers Association told local FOX 5 that one of the officers suffered serious injuries to his face and neck.

A criminal investigation led by the New York State Unified Court System is currently underway. The suspect's identity and what charges they may face have not yet been released.

The stabbings took place in the same building where President Donald Trump's criminal trial and Daniel Penny's trial took place. In December 2024, Penny was found not guilty of criminally negligent homicide in the subway chokehold death of Jordan Neely.

Israel activates 'Barak Magen' aerial defenses for system's first ever interception

Israel activated a new aerial defense system – dubbed "Barak Magen," meaning "lightning shield" – for the first time on Sunday night, saying it intercepted and destroyed multiple Iranian drones.

The Israeli Navy intercepted eight Iranian drones using the "Barak Magen" and its long-range air defense (LRAD) interceptor, which were launched from an Israeli navy Sa’ar 6 missile ship, the Israel Defense Forces (IDF) said in a statement.

John Hannah, senior fellow at the National Security of America and the co-author of a report published earlier this month on Israel’s defense against two massive Iranian missile attacks in 2024, told Fox News Digital on Monday that the air defense system "significantly enhances" the air and missile defense architecture of Israel’s navy.

"The Barak Magen is simply another arrow in the expanding quiver of Israel’s highly sophisticated and increasingly diverse multi-tiered missile defense architecture – which was already, by leaps and bounds, the most advanced and experienced air defense system fielded by any country in the world," Hannah said.

USS NIMITZ CARRIER STRIKE GROUP SAILING TOWARD MIDDLE EAST AHEAD OF SCHEDULE, US OFFICIAL SAYS

The system can intercept a "wide range of threats," according to the IDF, including unmanned aerial vehicles (UAVs), cruise missiles, high-trajectory threats and shore-to-sea missiles.

Hannah said the system not only provides force protection for the Israeli fleet but also gives long-distance protection to Israel’s expanding oil and gas infrastructure in the eastern Mediterranean, along with critical infrastructure and population centers located along Israel’s coastline.

"It allows Israel to conduct interceptions at significant distances from the Israeli homeland, both out in the eastern Mediterranean and the Red Sea, and thereby adds critically important strategic depth when defending Israel’s tiny geographic area," he said.

The IDF said that the Israeli Navy’s missile ship flotilla has intercepted about 25 UAVs that posed a threat to Israel since the conflict with Iran escalated.

ISRAEL SAYS IT HAS AERIAL SUPERIORITY OVER TEHRAN, IRANIAN INTELLIGENCE LEADER KILLED

Israel and Iran traded missile strikes for the fourth day on Monday, with Iran firing a new wave of strikes that killed at least eight people and wounded dozens more.

Meanwhile, the Israeli military claimed it had achieved air superiority above Tehran, warning about 330,000 people in a central part of the Iranian capital to evacuate ahead of new strikes.

EXCLUSIVE: New ‘Gavin Newsom files’ reveal California governor’s ‘extreme’ agenda

EXCLUSIVE: Following a week of violent riots in Los Angeles, conservative activist group Catholic Vote has released a report titled the "Gavin Newsom files," a report highlighting what the group calls the California governor’s "extreme" and "viciously anti-Christian agenda."

Newsom, the Democratic governor of California, is among the top names being rumored for a 2028 presidential run.

Over the last week, he has been locked in a protracted war of words, which has also manifested itself in a court battle, over President Donald Trump’s response to the riots in Los Angeles. Newsom has called Trump’s use of the National Guard and Marines to respond to the rioting both "immoral" and "illegal."

A longtime progressive, Newsom has recently moved to present himself as more of a centrist, starting a podcast titled "This is Gavin Newsom" that hosted the likes of conservative commentator Charlie Kirk.

According to Catholic Vote’s report, however, Newsom is "one of America’s most radical, destructive politicians" who "remains the same ideologue who has trampled parental rights, championed the transgender mutilation of children, and taken pro-abortion advocacy to a sickening extreme."

LOS ANGELES ANTI-TRUMP PROTEST DRAWS THOUSANDS OF PARTICIPANTS

"California’s governor claims to be a Catholic ‘man of faith,’" says the report. "But he has a viciously anti-Christian agenda for America."

Brandon Richards, a spokesperson for Newsom, responded to the report by telling Fox News Digital that "we're not taking seriously any organization co-founded by a political hack who has sworn allegiance to President Trump, called Pope Francis’ papacy a ruse, and justified cutting off U.S. foreign aid for the poor and hungry because he'd read some conspiracy theory about transgender mice experiments."

Catholic Vote endorsed Trump for president in 2024 and Catholic Vote founder Brian Burch was selected to be the administration's U.S. ambassador to the Vatican.

Richards said, "we encourage Catholic Vote, which does not represent the Catholic Church, to read Leviticus: ‘You shall treat the stranger who sojourns with you as the native among you, and you shall love him as yourself, for you were strangers in the land of Egypt: I am the Lord your God.’"

The report highlights how, despite his recent rebranding, Newsom has long been at the forefront of pushing for ever more liberal policies, championing causes such as abortion and transgender treatments for children.

"Gavin Newsom may be adjusting his style and image. But he remains the same ideologue who has trampled parental rights, championed the transgender mutilation of children, and taken pro-abortion advocacy to a sickening extreme," says the report.

As a politician with rumored presidential aspirations, Catholic Vote highlights how Newsom has advanced his liberal agenda not just in California, but across the entire country.

PHOTOS: SEE THE ANTI-TRUMP VIOLENCE THAT HAS UNFOLDED ON LA'S STREETS ACROSS THE LAST WEEK

The group quoted Newsom from a 2008 interview during a court battle over same-sex marriage, saying: "As California goes, so goes the rest of the nation. It’s inevitable."

Catholic Vote takes particular issue with Newsom’s abortion advocacy, pointing to how he has aggressively expanded abortion in California, signing 12 pro-abortion bills in a single month in September 2022 and nine more again in 2023. The report says that despite professing to be a Catholic, Newsom has not only advocated for a right to abortion, but even used biblical scripture to advertise and promote abortion.

The report points to how, as governor, Newsom commissioned billboards in Oklahoma that advertised "Need an abortion? California is here to help," with a quote from the Bible saying, "Love your neighbor as yourself. There is no greater commandment than these."

"This was deemed ‘unconscionable’ by the California Catholic Conference, and a ‘reprehensible act of gross blasphemy’ by a leading Protestant pastor. A statement from the Catholic League summed it up best, calling the billboard campaign ‘demonic,’" says the report.

GOV NEWSOM ‘HANDCUFFED’ POLICE AS LA RIOTS EXPOSE ‘REACTIONARY’ LEADERSHIP FAILURE: FORMER SHERIFF’ S DEPUTY

Catholic Vote stated that "Few figures demonstrate the drift of America’s political Left – away from the Clinton-era language of ‘safe, legal, and rare,’ and toward today’s ‘#ShoutYourAbortion’ attitude – better than Gavin Newsom."

The report also points to how Newsom has led the nation to "warp" the concept of parental choice to use it as a tool to advance transgender treatments for children. It points to how Newsom signed a bill in 2022 making California the nation’s first "sanctuary state" for parents from other jurisdictions seeking to give their children hormone treatment, puberty-blocking drugs and more. It says that in 2023, Newsom again "doubled down on this strategy of imposing radical ideology and calling it ‘freedom.’ When he instituted new penalties on public school districts that fail to promote homosexuality and transgenderism to children, he framed this as a matter of ‘families’ having ‘the freedom to decide what’s right for them.’"

According to the report, Newsom’s office released a statement in 2023 after he signed a slate of "Supporting LGBTQ+ Californians" policies that declared "hate-filled attacks" of "far-right extremists" would "not be tolerated."

Catholic Vote said that "if California is indeed ‘America’s Coming Attraction,’ as Newsom claims, believers in Biblical truth – and biological reality – should be gravely concerned."

CHILDREN'S HOSPITAL LOS ANGELES HALTS TRANSGENDER CARE AMID PRESSURE FROM TRUMP ADMINISTRATION

"Inevitably, the advance of LGBTQ ideology threatens religious liberty and authentic freedom of conscience in society. These ideologues demand forms of approval and practical compliance that faithful Christians, and other critics of gender nonsense, cannot give them," says the report.

"Americans have been shocked by the rioting and chaos in Los Angeles, but sadly, this reckless governance is all too common in Gavin Newsom's California," Catholic Vote Vice President Josh Mercer told Fox News Digital.

"As our new report, Newsom Files points out, the California governor refused to deal with vexing problems like drug dealers, shoplifters and the rampant homeless camps. Instead, Gavin Newsom was busy dreaming of the White House and spending taxpayer funds to put up billboards in Oklahoma that quote the Bible and urge people to fly to California to get an abortion," he said. "With his wacky priorities, it's no wonder people are fleeing California in droves."

Dodgers pitcher Clayton Kershaw displays Bible passage on hat during Pride Night

Los Angeles Dodgers pitcher Clayton Kershaw is going viral on social media after appearing to wear a hat with a Bible passage written on the front during the organization’s Pride Night celebration.

Kershaw wore a Dodgers hat with a rainbow-colored team logo during Friday’s game against the San Francisco Giants.

Screenshots of the broadcast shared on social media showed that the message "Gen 9:12-16" was also written on the front, seemingly in reference to Genesis 9:12-16.

The passage referencing God’s covenant with Noah points to the rainbow as a sign of that promise.

The Dodgers did not immediately respond to Fox News Digital’s request for comment.

Kershaw notably protested the organization’s decision in 2023 to honor the Sisters of Perpetual Indulgence before the team’s Pride Night game that season. The three-time Cy Young Award winner said his opposition was based solely on the group’s mockery of Christianity.

"I don’t agree with making fun of other people’s religions," Kershaw said. "It has nothing to do with anything other than that. I just don’t think that, no matter what religion you are, you should make fun of somebody else’s religion. So, that’s something that I definitely don’t agree with."

DODGERS' CLAYTON KERSHAW TAKES ISSUE WITH CARDINALS' PREGAME ANTICS BEFORE START

Kershaw said at the time that his issue was specifically with the group and that he had no intentions to boycott Pride Night.

"This has nothing to do with the LGBTQ community or Pride or anything like that," Kershaw told the Los Angeles Times. "This is simply a group that was making fun of a religion that I don’t agree with."

Friday marked the Dodgers’ 12th annual Pride Night event.

Not long after facing backlash in 2023, the Dodgers announced they would also be hosting Christian Faith and Family Day for the first time since 2019.

Defense Sec. Hegseth says Trump is 'dialed in' to Israel-Iran conflict, not the time for an 'autopen moment'

Secretary of Defense Pete Hegseth assured Americans on Saturday that President Donald Trump is "dialed in" to the escalating conflict between Israel and Iran and asserted that this is not an "autopen moment" for the president.

Hegseth told "Fox and Friends": "The American people can be assured that President Trump is dialed in. This is not an autopen moment. We had that where the world saw our gaze distracted or not paying attention at all. President Trump is dialed in. I get to see it every single day. He knows every single dynamic of what's going on here, and I'll tell you what he's doing here, Rachel. He's putting America first."

Israel Defense Forces launched a sweeping strike on Iran following months of attempted, and seemingly failed, nuclear negotiations. Iran retaliated to Israel's strikes yesterday, firing a barrage of ballistic missiles into various regions of the Jewish state.

LAWMAKERS, MEDIA DINGED FOR BLAMING TRUMP OR RIPPING ISRAEL ON IRAN: 'YOU THINK KAMALA COULD'VE STOPPED THEM?'

The defense secretary's autopen comments come on the heels of an investigation launched by the Trump administration into former President Joe Biden's use of the tool to allegedly cover up his declining mental acuity.

When asked by Fox News' Charlie Hurt about the latest developments in the conflict, Hegseth replied that the administration is monitoring the situation in real time and that Trump has been "leading the way on setting the tempo of how we look at the region."

He also noted that Israel felt they "needed to take action against [Iran's] nuclear capabilities and ballistic missiles" in self-defense, adding that the United States is "robustly postured to ensure that our people, our bases, our interests are safe."

"We will keep Americans safe… Ultimately it should be clear to Iran that they should not turn their gaze to the United States. That would be a bad idea," Hegseth asserted. "And the president continues to message that he prefers peace, he prefers a solution to this that is resolved at the table."

The defense chief told the panel that the administration knew about Israel's strike on the Iranian regime ahead of time and is currently focused on keeping the American people safe.

"That's our job, not to be completely caught off guard, to understand the situation in front of us and then calibrate accordingly. And provide maximum decision space to the president of the US to keep Americans safe," he said. "So I wouldn't say we were really surprised by any dynamic of the back and forth that's been ongoing, but we're monitoring it closely."

In his final thoughts on the conflict, Hegseth emphasized Trump's demand that Iran not pursue acquiring a nuclear weapon, and noted that Israel believed Iran's nuclear aspirations were a threat to them — and that's why they took action.

"As this back and forth continues, as I said, we're going to defend our folks, and the president is also making — and by the way robustly and strongly — this is not some sort of a perspective where we're worried or concerned. We're vigilant, we're prepared in a strong defensive posture," he declared. "While the president continues to say to Iran, 'Hey you have any option for peace. It includes, you know, various aspects of what's been discussed.' Iran knows. They know they can come back. They're making their own decisions right now, and we hope they would choose a negotiated option."

Minnesota rep killed made headlines days earlier over controversial immigration vote

Minnesota Democratic Rep. Melissa Hortman, who was fatally shot on Saturday with the suspect still at large, made headlines earlier this week for being the only Democratic vote in the state House to vote to repeal taxpayer-funded healthcare coverage for adult illegal immigrants.

"I know that people will be hurt by that vote and I’m – we worked very hard to try and get a budget deal that wouldn’t include that provision," she said following the vote that she said was done in order to move the budget forward in a split legislature, according to KTTC. Republicans hold the House 67-66, and the Democratic-Farmer-Labor Party holds the Senate 34-33.

Sen. John Hoffman and his wife were also shot on Saturday and are hospitalized following surgery. Hortman’s husband also died in the shooting. All four victims are presumed to have been shot by the same suspect who pretended to be a police officer.

MINNESOTA LAWMAKERS AND SPOUSES SHOT IN SEPARATE HOME ATTACKS

According to Alpha News, Hoffman voted against the proposal but Gov. Tim Walz is expected to sign it into law as part of the budget agreement. Four state senators also voted for the repeal.

Although it’s believed to be politically motivated, the specific motive is unclear as of Saturday afternoon. Minnesota State Patrol posted a photo to X on Saturday showing "No Kings" signs in the suspect’s vehicle. "No Kings" is the name of the nationwide series of protests happening on Saturday in opposition to the Trump administration.

The tragedy led to an outpouring of messages from both sides of the aisle.

"I have been briefed on the terrible shooting that took place in Minnesota, which appears to be a targeted attack against State Lawmakers," Trump posted to Truth Social on Saturday. "Our Attorney General, Pam Bondi, and the FBI, are investigating the situation, and they will be prosecuting anyone involved to the fullest extent of the law. Such horrific violence will not be tolerated in the United States of America. God Bless the great people of Minnesota, a truly great place!"

Hortman was formerly the state House speaker.

Young voters give Trump mixed grades in NY Times survey, but majority say US will be ‘better’ in four years

Many of the young voters recently surveyed in a New York Times focus group gave President Donald Trump passing grades for his term so far, with a majority of those asked saying they believe the country will be better off once he's done with it.

The Times spoke to 13 voters in their 20s about how they feel about "the way things are going in the country these days" – a topic area that included their thoughts on artificial intelligence, social media, the economy, the current political climate, and the future. While many expressed worry about the current state of the country, eight said they believe Trump is doing fine, and seven said the country will be better off in four years.

"I like how stern he is, how focused he is on at least trying to get something done," a 23-year-old Latino and Republican voter named Evan said of Trump. "But I mean, I feel as though Trump actually cares about creating change. Pep in his step, at least. Biden was, like, a Sleepy Joe."

FOX NEWS POLL: THE FIRST 100 DAYS OF PRESIDENT TRUMP’S SECOND TERM

The Times asked these 13 20-somethings, "Do you think things will be better, worse or the same four years from now?" Seven of them agreed that things "will be better," three said things "will be worse," and three said they would remain "the same."

One of the more optimistic individuals was a 27-year-old woman and Democratic voter named Jonnie.

She told the Times, "I just think this administration will stabilize. I think it’s scaring a lot of people. Maybe I’m just being hopeful, too. But I think inflation will probably be better by then. I can’t imagine this direction forever. I think things will just stabilize."

YOUNG AMERICANS SOUR ON CONGRESSIONAL DEMOCRATS, NEW POLL FINDS

Evan told the paper he thinks things will be better because the Trump administration will do a better job the second time around.

"I would just hope they’ll learn from their past mistakes. After four years, if you don’t get better or something, then what are you doing? So I would just hope," he said.

However, a Democratic voter from Texas named Bayleigh told The Times she believes things will remain as chaotic as she says things have been.

"It’ll be the end of Trump’s administration, but I think the instability will remain consistent through the next four years," Bayleigh said.

Later in the survey, the outlet asked the 13 individuals to give Trump a letter grade. No one gave him an A, but five of them – three Republicans and two independents – gave him a B. Three of them – two independents and one Democratic voter – gave him a C. One Republican and a Democrat gave him a D, and a Democratic voter named Molly gave him his only F out of the group.

The Times asked Darrion, a Republican from Indiana, why he gave a Trump a C.

"I think it’s a little bit positive and negative," Darrion said. "I’m positive in the sense that I like the way he’s portraying the image of America on an international scale, like the trade wars, tariffs and all that. And negatively because of his impact in cryptocurrency and the stock market."

Jonnie, the Democratic voter who gave Trump a C, told the outlet, "Nothing horrible has happened, really. I guess that makes it OK. But at the same time, tariffs and stuff — I don’t like that."

GREGG JARRETT: Trump's deployment of National Guard is justified despite knee-jerk judicial roadblock

Here we go again.

It should surprise no one that a liberal judge seated in San Francisco sided with California Democrat Gov. Gavin Newsom over control of the National Guard amid the anti-ICE protests that led to riots, looting and attacks on federal agents in Los Angeles.

The court hearing on Thursday afternoon was a mere formality.  A charade.

9TH CIRCUIT GRANTS TEMPORARY STAY OF ORDER FOR TRUMP ADMIN TO HAND BACK CONTROL OF CALIFORNIA NATIONAL GUARD

Hours later, U.S. District Judge Charles Breyer, a Clinton appointee and younger brother of retired Supreme Court Justice Stephen Breyer, issued his preordained order blocking President Donald Trump’s deployment of 4,000 Guard troops who had managed to suppress much of the violence.

Immediately, the 9th Circuit Court of Appeals issued a temporary stay of Breyer’s ruling.  So, for now, a legal stasis exists as the tinder box of protests simmers.  Further hearings will determine who is abusing power —the president or the judge.

Based on the law and historical precedence, Trump has the better argument. He acted swiftly to save lives and property as Newsom dithered.

TRUMP TELLS JUDGE HE DOES NOT NEED NEWSOM’S PERMISSION TO CRACK DOWN ON RIOTERS, DEPLOY NATIONAL GUARD

Let’s step back.  Last weekend, the Chief of the L.A. Police Department publicly lamented that the rioting raged "out of control" and his forces were "overwhelmed."  He warned that "somebody could easily be killed."

In the face of escalating violence, Newsom failed or refused to quell the mob assaults on officers of Immigration and Customs Enforcement (ICE) who were carrying out their lawful functions.  With lives at risk and federal property under attack, President Trump federalized the National Guard to provide needed protection and help restore law and order.

When the tumult on the streets of L.A. worsened, Secretary of Defense Pete Hegseth deployed a group of U.S. Marines to further assist.

Predictably, Newsom took a page out of the Democrats’ anti-Trump "lawfare" playbook and sprinted to a federal judge in San Francisco seeking a temporary restraining order (TRO) against the President.  This posited the inexorable debate of state versus federal powers.

It is a fundamental duty of the President to enforce all laws, protect citizens and ensure public safety.  This is an inherent power derived from Article II, Section 1 of the Constitution and an essential function of the chief executive.  But there is more.

FEDERAL JUDGE ORDERS TRUMP TO RETURN CONTROL OF CALIFORNIA NATIONAL GUARD TO NEWSOM

By special statute passed long ago, Congress granted the president extraordinary powers to subdue any civil disorder directed against the enforcement of federal law.  (10 U.S.C. 12406).  Historically, these powers have been wielded by other presidents, most notably during the civil rights struggles decades ago.  They often did so without the consent of governors who opposed them.

Newsom has no authority to countermand the president’s order. Moreover, "There is no rioters’ veto to enforcement of federal law," as the Department of Justice (DOJ) argued in its legal brief before Judge Breyer.

Under Title 10 of the United States Code the president has complete authority to federalize the California National Guard.  Once invoked, neither a governor nor a judge may second-guess whether such a sensitive and discretionary judgment is justified.  All due deference must be given to the Commander in Chief when national security is threatened.

Only the president is empowered to decide what forces "he considers necessary" to "suppress" a "rebellion or danger of a rebellion" or "to execute the laws of the United States," as DOJ lawyers reminded the judge by quoting directly from the statute.

Newsom contends that Trump may not act without his express permission.  But such a requirement is found nowhere in the law.  Instead, the statute specifically provides that the president’s order "shall be issued through the governors of the States."  This is a procedural step for the ministerial conveyance of an order.  It is not contingent on the Governor’s assent, or the statute would have said so.

Newsom erroneously asserts that Trump is barred from acting by the Posse Comitatus Act of 1878 that prohibits the use of federal troops for policing on domestic soil.  This is a frivolous argument.  The National Guard and Marines are not engaged in law enforcement.  Their principal roles are protecting the safety of federal property and personnel.

JUDGE MULLS TRUMP'S AUTHORITY OVER NATIONAL GUARD, WARNS US IS NOT 'KING GEORGE' MONARCHY

The president could invoke the Insurrection Act of 1807 which serves as an exception to the Posse Comitatus Act, whenever enforcement of federal laws is impeded.  The President could do so without waiting for a reversal from a higher court.  This would effectively end the Governor’s attempt at obstruction.  The latter Act has been invoked numerous times, the latest of which was the 1992 riots in Los Angeles.

The sanctity of California’s sovereignty is another of Newsom’s canards.  The Supremacy Clause found in Article VI of the Constitution ensures that state laws are subordinate to federal law and cannot supersede it.  This includes sovereignty, which is an elastic concept in the rubber band of politics. But it does not negate the fact that federal laws take precedence over conflicting state laws.

The legal imbroglio could have been avoided if Newsom had acted responsibly at the outset when it was obvious that protests would swiftly morph into violent riots.  Yet, he and fellow Democrats clung to the fiction that the surging demonstrations were "mostly peaceful" —a trite and tired deceit borrowed from the ugly BLM riots in 2020.

The left and their extremist followers operate under the delusion that Americans are blind and cannot see with their own eyes the vivid pictures of the vandalism and looting, vehicles set ablaze, freeways shutdown, and rioters hurling rocks, bottles, bricks and chunks of cement at law enforcement officers.  They fail to comprehend that arson, theft, destruction of property, and assault and battery are serious crimes.  They want you to believe that violent felonies are nothing more than minor skirmishes and mischief to be overlooked.

Obsessed with their hatred of Trump, the party out of power seeks to vilify the president. Rather than looking inward, they blame him for the riots, as if enforcing the law by arresting and deporting people who are here illegally —including murderers, rapists, and child molesters— is somehow immoral and unsanctioned by voters who placed him in office based in large part on the promise that he would remove them.

In this way, Democrats own the lawlessness they now passionately defend.  By their inflammatory rhetoric aimed at both ICE and Trump, they laid the groundwork, set the fuse, and then watched it ignite into the flames of bedlam.

They care more about providing sanctuary for illegals than they do about the safety and welfare of innocent citizens who are preyed upon or the law enforcement community under siege.  It doesn’t matter to them that "somebody could easily be killed," as the Chief of L.A. Police warned.

Newsom and his party offer no real remedy to the mayhem roiling the streets of Los Angeles, only condemnation of a president who does.
